This HandCash Referral Program (the “Referral Program”) offers existing HandCash Users the opportunity to earn a referral reward as specified below (the “Reward”) by referring friends to sign up to HandCash and use our wallet top-up service (The “Top-up Service“).
HandCash Labs, S.L. ("we", "us", “HandCash” and/or the “Company“) is a Spanish limited liability company with corporate domicile at Avenida de Europa número 26, Ática 5, Piso 2 (28224 - Pozuelo De Alarcón) Madrid, Spain. Our Fiscal Identification Number (Tax Id #) is: B-88154141.
These terms (“Terms“) apply to a existing HandCash User's (“User“) participation in the Referral Program. By participating in the Referral Program, Users agree to use the Referral Program as outlined herein, and consistent with HandCash’s Terms of Service any other additional terms we may apply at any time and at sole discretion to the Referral Program. If you do not agree to these Terms in their entirety, then you cannot participate in the Program. Users also cannot where in so doing, they would violate any applicable law or regulations.
This Referral Program runs from 24 February 2022 00:00 AM GMT for an indefinite period of time, until such at time when terminated by HandCash, the “Referral Period”.
Please note that the Referral Program will be terminated at some time in the future. For the avoidance of doubt, please note that we reserve the right to finalize the Referral Period and/or terminate the Referral Program in its entirety at any time for any reason. The Referral Program is administered by HandCash Labs, S.L., which may, outsource certain elements of its administration to third parties.
This Referral Program is void where such referral programs are prohibited and/or conditioned to any special regulatory requirements not covered by these Terms. Users who refer others to the program are “Referrers“; those who are referred are “Referred Users“. Referrers must speak and read English, comply at all times with these Terms, be legally able to participate in the Program, and must be 1) at least the age of majority where they reside, 2) have an existing, valid HandCash user account, and 3) are otherwise in good standing as per HandCash’s Terms of Service. Participation in the Program represents an ongoing relationship with you, for data protection purposes. Please see HandCash’s Privacy Policy for further details on your privacy rights. Companies and employees of HandCash or any of its subsidiaries, affiliates or promotional agencies, including immediate family and household members, are not eligible to participate in the Referral Program.
To earn a Reward, a Referrer just needs to share their very own unique invitation referral link with any friends interested in becoming HandCash Users. A new user that successfully signs up to HandCash using any Referrer’s unique invitation referral link becomes a Referred User of such Referrer. (Please note that successfully signing up means completing the sign up process and passing any onboarding checks, as applicable.)
Any given Referred User can only have a single Referrer. Once a Referred User has been linked to a Referrer such action cannot be altered or reversed.
From the moment that any new user referred by you proceeds to use HandCash’s Top-up Service (using an external funds source such as a credit card, not a transfer from another HandCash account), you will earn 15% of HandCash’s commission net of any applicable fees deducted or payable to any third parties such as acquisition costs, credit card fees, etc. (“HandCash’s Net Commission”) over any such top-ups.
Any Rewards will be paid within 24 hours by direct top-up to the Referrer’s HandCash account balance.
Please note that you will not be paid a Reward (or may have a Reward that has been previously paid reversed) if your invitee reverses or cancels/refunds their corresponding top-up purchases.
This Promotion is a one-sided campaign, where only the referrer (not the referee) can be awarded the Reward. Upon the termination, for any reason, of this Referral Program, no additional Rewards will be accrued and/or paid to any Referrers.
Except where prohibited, Users agree that by participating in the Referral Program, they agree: (1) to be bound by these Terms and by the decisions of HandCash, its Administrators and/or their designees, as well as by HandCash’s terms of service and privacy policies; (2) to release and hold harmless HandCash affiliates and subsidiaries, together with their respective employees, directors, officers, licensees, licensors, shareholders, attorneys and agents including, without limitation, their respective advertising and promotion entities and any person or entity associated with the production, operation or administration of the Referral Program (collectively, the ”Released Parties”), from any and all claims, demands, damages, losses, liabilities, costs or expenses caused by, arising out of, in connection with, or related to their participation in the Referral Program (including, without limitation, any property loss, damage, personal injury or death caused to any person(s) and/or the awarding, receipt and/or use or misuse of the Program or any Award); and (3) to be contacted by HandCash via e-mail.
Except where prohibited by law, the Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind resulting from acceptance, possession or use of a Credit, or from participation in the Program; or (v) any printing, typographical, administrative or technological errors in any websites or materials associated with the Referral Program. We disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Referral Program.
Except where prohibited, the Released Parties shall not be liable to any Users for failure to supply any Award or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, tornado, tsunami, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other similar or dissimilar cause beyond any of the Released Parties' control.
As a condition of entering the Referral Program, and unless prohibited by law, Users agree that under no circumstances will Users be entitled to any awards for any losses or damages, and Users hereby waive all rights to claim punitive, incidental, consequential and any other damages, and waives any and all rights to have damages multiplied or otherwise increased.
As previously stated, this Referral Program will be terminated at a future date. HandCash reserves the right to terminate the Referral Program at any time for any reason. In addition to the foregoing, HandCash reserves the right to cancel or suspend this Referral Program should it determine, in its sole discretion, that the administration, security or fairness of this Referral Program has been compromised in any way.
Except where prohibited, disputes, claims and causes of action arising out of or related to this Program or any prize awarded shall be resolved under the laws of the Kingdom of Spain and all participants in this Referral Program agree to submit any dispute to the exclusive jurisdiction of the courts of the city of Madrid, Spain.
