  1. While registering as a User of the platform “HANDCASH” located on the website handcash.io, handcash.me and the relevant apps (hereinafter – the Platform) which belong to HANDCASH LABS USA, Inc. (hereinafter together – the Company), you (hereinafter – the Data Subject) confirm that you have read this personal data processing Privacy policy (hereinafter – the Policy) and agree for your personal data processing in accordance with the Policy.
  2. The Policy sets methods of work with personal data which were collected by the Company while concluding any agreements (incl. User Agreement) with the Company. The Data Subject agrees for his/her personal data processing in accordance with the Policy and affirms that. In case when the Data Subject does not agree with the Policy partially partly or fully, he/she must not conclude (or plan to conclude) agreement(s) with the Company. All data collected before such refusal will be processed in accordance with Policy until the direct Data Subject prohibition is received.

It is important for you to review this Privacy Policy carefully. In order to operate and provide the Bitcoin SV Wallet website, application (the "App") and related services (together the “Services”) and to reduce the risk of fraud, we must ask you to provide us with information about yourself. This Privacy Policy describes how we collect, use and disclose any personal data we collect from you, or that you provide to us. It also describes the choices available to you regarding the use of, your access to, and how to update and correct your personal information.

A Special Note About Children

Children are not eligible to register an account with our services (with their own phone number) and we ask that minors (under the age of 18) do not submit any personal information to us or use our services without the appropriate parental consent. We do not knowingly solicit data from, or market to, persons under the age of 18. If a parent or guardian becomes aware that his or her child has provided us with information without his or her consent, he or she should contact us at info@handcash.io. We will delete such information from our files.

Information we collect and process

We will collect and process the following data about you:

Information you provide to us.

This is information about you that you give us by providing us with your details via the App or by corresponding with us by phone, e-mail or otherwise. It includes registration information and information you provide if you report a problem with our App. The information you provide to us may include:

  • identification data and contact information (e.g. your name; address; telephone number, email address; date of birth);

  • banking and payment information (credit card information, account number) for accounts linked to your Bitcoin SV Wallet account;

  • copies of government-issued identification, such as a driver's licence, passport or other documents such as a recent utility bill;

  • transaction information, such as the amount of the transaction, type of transaction and payment information;

  • results of any surveys you complete; and

  • other information that you include on your Bitcoin SV Wallet profile.

  • Information you provide to us. We collect the following information when you use the App:

    • technical information, including the Internet protocol (IP) address used to connect your phone, tablet or other device to the Internet, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;

    • information about your usage of and interaction with Bitcoin SV Wallet, our products and websites including computer, platform, device and connection information, device capability, carrier network, bandwidth, statistics on page views, and traffic to and from our websites, operating system or browser type;

    • details of the products or services ordered and delivered;

    • transaction histories;

    • correspondence between you and us, including email, telephone logs or recordings, or instant message content, or messages between or to your contacts or other Bitcoin SV Wallet users when sent using the Bitcoin SV Wallet system;

    • Bitcoin SV Wallet prepaid card details and usage.

    • When a Bitcoin SV Wallet user sends a payment to or requests a payment from an individual who is not a registered member of Bitcoin SV Wallet, we also retain the information that the member submits to us about the non-member.

  • Information we receive from other sources. We may receive about you if you use any of the other websites we operate or the other services we provide. In this case we will have informed you (through such other websites or other services we provide) when we collected that data if we intend to share those data internally and combine it with data collected on this App. We will also have told you for what purpose we will share and combine your data. We also work with third parties (including, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) who may provide us with personal information about you.

How we use your information

We use information held about you in the following ways:

  • Information you provide to us

    This is information about you that you give us by filling in forms on our App or by corresponding with us by phone, e-mail or otherwise. It includes information you provide, for example, when you register to use our App, subscribe to any services we provide, and when you report a problem with our App. We use the information you give to us in the following ways:

    • Where we need to use the information to carry out our obligations arising from contracts entered into between you and us and to provide you with the information, products and services that you request from us. This is necessary for us to provide you with the Services. To allow you to purchase Bitcoin SV into your Bitcoin SV Wallet account, we will normally ask you to provide additional personal information (which may include a copy of government-issued photo identification, and supporting address documentation) necessary to validate your identity for legally-required “Know Your Client” purposes, and to comply with our legal obligations such as anti-money laundering and anti-terrorist financing laws and regulations. We may also require other commercial and/or identification information if you send or receive certain high-value transactions or high overall payment volumes through the Bitcoin SV Wallet Services in order for us to comply with our anti-money laundering or other legal obligations. If we cannot verify the information that you provide, we may ask you to send us additional information (such as your driving license, credit card statement and/or a recent utility bill, or other information linking you to the applicable address), or to answer additional questions online to help verify your information. If you want to change your details or you have recently moved, we will need additional documentation from you.

    • When you use Bitcoin SV Wallet, we ask you to provide information related to that transaction, including such information as the amount of the transaction, the type of transaction and payment information. Also, when you send money to another Bitcoin SV Wallet user, you may be asked to provide personal details to that customer to complete the transaction and those details may also be passed on to us from that customer. We retain this information for each of your transactions through Bitcoin SV Wallet and may add this information to your account profile to be used for future transactions that you may make with us. We do this where necessary in order to comply with our contractual obligations to you,. or where it is necessary for our legitimate business purposes in providing you with a faster and more efficient service.

    • We use the information you provide to us (together with information that we collect from you) for the purposes of delivering tailored marketing, advertising and promotional offers of other services that we offer, based on the communications preferences you have specified in your Bitcoin SV Wallet account.

    • If we correspond by telephone, we will typically request certain personal information from you, such as your date of birth, address and email address, in order for us to confirm your identity.

  • Information we collect

    When you use our App, we use cookies and similar technologies to automatically collect the following information:

    • technical information, including your IP address, your login information, browser type and version, time zone setting, browser plug-in types and versions, and operating system and platform;

    • Information about your visit, including the full Uniform Resource Locators (URL), products or services you viewed or searched for page response times, length of visits to certain pages, and page interaction information (such as scrolling, clicks, and mouse-overs).

    • We collect the IP address and other identifying information about the computer or device you use to create or access your Bitcoin SV Wallet account or use the Bitcoin SV Wallet Services, where this is necessary in our legitimate interests to help detect possible instances of unauthorised or fraudulent transactions.

    • We use the information we collect to administer our App and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes. This is necessary for our legitimate business purposes to monitor our services and ensure our App is functioning properly.

    • We use technical information and information about your visits to our App where this is necessary in our legitimate business interests to keep our App safe and secure.

    • We will analyse information on your recent use of the App and your past transactions to try to understand your preferences better and to manage the load on our servers, where this is necessary for the legitimate business purpose of improving our Services.

    • We use the information we collect from you (in combination with the information you provide to us) for the purposes of delivering tailored marketing, advertising and promotional offers of other services that we offer, based on the communications preferences you have specified in your Bitcoin SV Wallet account.

    • If you send us correspondence, we retain such information in the records of your account. We will also retain customer service correspondence and other correspondence from Bitcoin SV Wallet to you. We retain these records in order to keep records of our relationship to measure and improve our customer service, and to investigate potential fraud and violations of our Terms of Service. We retain and use this information as necessary to comply with our legal obligations, for the purposes of meeting our contractual obligations to you, and where this is necessary in our legitimate interests to resolve disputes and enforce our legal rights.

    • When a Bitcoin SV Wallet user either sends a payment to, or requests a payment from, an individual who is not a registered member of Bitcoin SV Wallet, we will retain the information that the member submits to us for the benefit of the member who is attempting to contact the non-member, where this is necessary in our legitimate business interests to allow the member can see a complete record of his or her transactions, including uncompleted transactions.

  • Information we receive from other sources

    In order to protect our customers against potential fraud, we verify the information you provide with identity verification services, payment processors and/or credit reference and fraud agencies. In the course of such verification, we may receive personal information about you from such services. In particular, if you use a credit card or debit card with Bitcoin SV Wallet, we will use card authorisation and fraud screening services to verify that your card information and address match the information you supplied to Bitcoin SV Wallet, and that the card has not been reported as lost or stolen. If you send or receive high overall payment volumes through Bitcoin SV Wallet, in some circumstances we are required to conduct a background check on you by obtaining information about you from a credit reference or fraud agency. If you owe us money, we may conduct a credit check on you by obtaining additional information about you from a credit reference or fraud agency, to the extent permitted by law. We may periodically retrieve and review a consumer credit report supplied by such credit reference or fraud agency for any account, and reserves the right to close an account based on information obtained during this credit review process.

    Please note that third parties have their own privacy policies and that we have no control over how third parties use personal information. You should check the privacy policies of third party sites and applications before you submit any personal information to these websites or applications.

  • Personal data of friends

    You may be interested in inviting your friends or contacts to join Bitcoin SV Wallet. In the event you wish to use Bitcoin SV Wallet’s referral service, you will be directed to a webpage and may have the option of adding one or more email addresses in an online form. The information entered in this form will only be used for the purposes of automatically generating an email message to your friend inviting them to join Bitcoin SV Wallet. If your friend wishes to join Bitcoin SV Wallet, they will then need to give their consent to receive further communications from us.

    Please note that third parties have their own privacy policies and that we have no control over how third parties use personal information. You should check the privacy policies of third party sites and applications before you submit any personal information to these websites or applications.

Disclosure of your information

We may share your personal information with:

  • Any member of our group, which means our affiliates and subsidiaries, our ultimate holding company and its subsidiaries and affiliates.

  • Selected third parties including business partners, licensees, suppliers and sub-contractors for the performance of any contract we enter into with them or you; or

  • Selected third parties who may use this information to send you details of products and services that may interest you (provided you have consented to this); and

  • Analytics and search engine providers that assist us in the improvement and optimisation of our App.

We may disclose your information to these third parties for the following purposes:

  • Where this is necessary for us to fulfil our contractual obligations to you, to provide the Services you request;

  • Where this is necessary for us to verify your identity in order to comply with our legal obligations (for example under anti-money laundering and anti-terrorist financing laws);

  • Where this is necessary in our legitimate interests for the purposes of maintaining and improving the quality of our service; enforcing our Terms of Service and other legal rights; and for preventing and detecting fraud and other illegal activities;

  • For the purposes of allowing third parties to send you details of promotional offers that you may be interested in, provided you have consented to this.

Where we store personal data

The personal data that we collect may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It may be processed by staff outside the EEA who work for us or for one of our suppliers engaged in the processing of your personal details. We will take all reasonable and necessary steps to ensure your personal data is treated securely and in accordance with this Privacy Policy and applicable data protection laws, and will not transfer personal data outside the EEA unless an appropriate safeguard is implemented, such as entering into EU standard contractual clauses (or equivalent measures) with the party outside the EEA receiving the data.

Please note that unfortunately the transmission of information via the internet is not completely secure. Although we do our best to protect your personal data, we cannot guarantee its security once transmitted to our App; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Your rights

You have the right to ask us at any time not to process your personal data for marketing purposes, or to stop processing your data for these purposes if you have previously agreed to this. You can exercise your right to prevent the processing of your personal data for marketing purposes by checking certain boxes on the forms we use to collect your data. If you have already agreed to receive marketing communications from us but have now changed your mind, you can easily unsubscribe at any time by following the instructions (such as to click an “Unsubscribe” link in emails) included in these marketing communications. Our App may contain links to and from websites or applications of our partner networks, advertisers and affiliates. If you follow a link to these websites or applications, they have their own privacy policies and we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites or applications.

Access to information

Under applicable data protection laws (to the extent they apply to the App and to you), you have the right to:

  • Access. You have the right to request a copy of the personal information we are processing about you, which we will provide back to you in electronic form. For your own privacy and security, in our discretion we may require you to prove your identity before providing the requested information. If you require multiple copies of your personal data, we may charge a reasonable administration fee.

  • Rectification. You have the right to have incomplete or inaccurate personal information that we process about you corrected. Note that you can always make certain adjustments to certain personal information directly through your online account.

  • Deletion. You have the right to request that we delete personal information that we process about you, except we are not obligated to do so if we need to retain such data in order to comply with a legal obligation or to establish, exercise or defend legal claims.

  • Restriction. You have the right to restrict our processing of your personal information where you believe such data to be inaccurate, our processing is unlawful or that we no longer need to process such data for a particular purpose, but where we are not able to delete the data due to a legal or other obligation or because you do not wish for us to delete it.

  • Portability. You have the right to obtain personal information we hold about you, in a structured, electronic format, and to transmit such data to another data controller, where this is (a) personal information which you have provided to us, and (b) if we are processing that data on the basis of your consent (such as for direct marketing communications) or to perform a contract with you.

  • Objection. Where the legal justification for our processing of your personal information is our legitimate interest, you have the right to object to such processing on grounds relating to your particular situation. We will abide by your request unless we have compelling legitimate grounds for the processing which override your interests and rights, or if we need to continue to process the data for the establishment, exercise or defence of a legal claim.

  • Withdrawing Consent. If you have consented to our processing of your personal information, you have the right to withdraw your consent at any time, free of charge This includes cases where you wish to opt out from marketing messages that you receive from us.

Supplement Notice to California Residents.

This notice supplements the information contained in our Privacy Policy and applies solely to residents of the State of California. We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in supplemental notice (“CCPA Notice”). The CCPA grants California residents the right to know what personal information COMPANY collects, uses, and shares for our business purposes, during the preceding 12 months. This CCPA Notice does not include (i) publicly available information from government records; or (ii) information excluded from the CCPA’s scope (personal information covered by the Gramm-Leach-Biley Act (GLBA) or the California Financial Information Privacy Act (FIPA)).

A. Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Right to Know. You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the "right to know"). Once we receive your request and confirm your identity, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you in the preceding 12 months.
  • If we sold or disclosed your personal information for a business purpose in the preceding 12 months.

Right to Delete. You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the "right to delete"). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

B. Exercising Your Rights

Submitting a Request. To exercise your rights to request information, know, or delete, please contact privacy@handcash.io. Only you or someone legally authorized to act on your behalf may make a request related to your personal information. You may also make a request to know or delete on behalf of your child. We will require that the authorized agent have a written authorization confirming their authority.

Verification. Your request to access or delete personal information must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. We will ask you to verify your identity when you submit a request. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. You do not need to create an account with us to submit a request to know or delete.

Opt-out. California residents have the right to opt out. You (or your authorized representative) may submit a request to us by contacting [email]. You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not (i) deny you products or services, (ii) charge you different prices or rates for products or services, including through granting discounts or other benefits, or imposing penalties, (iii) Provide you a different level or quality of products or services, or (iv) suggest that you may receive a different price or rate for products or services or a different level or quality of products or services.

Supplemental Notice to Nevada Residents

Nevada provides its residents with a limited right to opt out of certain personal information sales. Nevada residents who wish to exercise their sale opt-out rights may submit a request to this designated email address: privacy@handcash.io, with the subject line “Nevada: Do Not Sell.” However, please note that we do not currently sell data so as to trigger Nevada’s opt-out requirements.

Security and storage of information

Your personal information is processed by us and/or our service providers only for the period necessary for the purposes for which the information is collected. When we no longer need to use your information for those purposes, we will remove it from our systems and records or take steps to anonymise it so that you can no longer be identified from it (unless we need to keep your information to comply with legal or regulatory obligations to which we are subject).
